lease agreement

I want to take on lease for a period of 20 years of 300 sq yds site for running an Industry form a person who is having SALE CUM GPA from the owners and that SALE CUM GPA is in forceable condition at present. So please suggest me the procedure & conditions for obtaining lease deed from the GPA Holder

You can take said lease for a period of 20 years from said Sale cum G.P.A.holder,but provision of rent act of your state will be binding on you.

GPA holder is not having sale deed in his own name. If the power is cancelled in the mean time then what? So better get signature of the true owner also in the lease deed to bind him.sale agreement binds only the person and not the land.Till the sale deed is executed,the possession is with the owner only.pl.also verify the sale agreement,whether possession is also given and whether it is registered.Proceed slowly,and with skilful drafting of the lease deed.

If the sale-cum-GPA provides the is irrevocable and it further provides power to the buyer-cum-GPA holder to further sub-lease, only then he can get it sub-lease in your favour otherwise there is no chance in the given case.

If the G.P.A. is registered and valid till today, and the executor of GPA has given the authority to give on lease to the authority holder......you can take property on lease from the GPA holder, it will be legal as it has executed by the authority holder of that property.

As Mr.Raj said, it is also to be verified whether the GPA provides for further lease or sub-lease, you can go ahead.
