(Querist) 26 September 2016 This query is : Resolved
Sir,My question is "Is there any rule for s.t people that they can not
sell their land if they have no lands more than 5 acers."in odisha
Raj Kumar Makkad (Expert) 26 September 2016
The Scheduled Tribe and Scheduled Castes are the most vulnerable among the weaker sections of the society. On account of their ignorance and simplicity they fall an easy pray to the unscrupulous money lenders and middlemen who exploit them in many ways.

Go through the following link for more details:

Sir,
In a case if a person belongs to Scheduled Tribe wants to transfer or sell his un-irrigated land and although he has less than five acres..then how he can sell it?
Rajendra K Goyal (Expert) 26 September 2016
Has to obtain permission from specified district authority.
Arjun Das (Querist) 26 September 2016
Mr.R k Goyal sir, specified authority like M.L.A/M.P or District Collector/sub-collector.?
kavksatyanarayana (Expert) 26 September 2016
for the lands in Schedule area, the District Collector of your area. You have to submit application before the District Collector of your area.
Raj Kumar Makkad (Expert) 26 September 2016
I do endorse the advice of kavksatyanarayana in this regard.

Arjun Das (Querist) 28 September 2016
And thank you Mr.R K Goyal sir,Ms. Usha Kapoor ma'am,Mr R K Makkad sir,and Mr.Kavksatyanarayana sir..for your suggestions.
Raj Kumar Makkad (Expert) 28 September 2016
Yes, he can sell but with the permission of collector as already advised.
P. Venu (Expert) 29 September 2016
There no such rules or regulation. It is only that such sales are subject to permission in certain notified areas. It is question of fact whether the land is situated in such a notified area.

In the instant case, there should not be any problem if the earlier owner was not a ST person.
Arjun Das (Querist) 29 September 2016
Sir, What kind of problem it will be..If the earlier owner was also a ST person?
Raj Kumar Makkad (Expert) 29 September 2016
In that case no permission is required.
Arjun Das (Querist) 29 September 2016
It means that person(govt. employee) can easily sell his land..and no permission required for sell it..although he has less than five acers of land.
Raj Kumar Makkad (Expert) 29 September 2016
It seems that you require our duly attested affidavit?
Arjun Das (Querist) 08 February 2017
Mr.Makkad sir,
here some lawyers are saying he can't sell his land..because the man who is selling the land also belongs to schedule tribe cast.
