home tutions

Hi, my wife has Sanskrit titions at home for 5th to 10th std kids at thane, MH. i stay at 1st floor. total kids count in my class is 25 as in total of all batches. other class on 5th floor having all subjects have more than 75 kids comes in.. so soc facing lots of problems as his classes runs till late upto 9.30 nite. bt soc failed to fight with him. decided to close down all commercial activities. bt i feel its injustice to us. soc dnt want to put up certain norms lke classes timings days to be maintained to avoid inconvenience. n we r in great need of our running home tutions.. would like to have ur help to tackle this situation.. can u pls guide me? is the home tution is really commercial activity?

Giving tutions at Home cannot be considered to be a commercial activity. However, discretion needs to be exercised in that such an activity does not inconvenience other occupants of the society and neighbours.

Yessss, Thanks for Revert Mr. Venu, But here there is an inconvenience happening by the other Class as they have more than 75 kids as in total n timings are also till late eve like 9.30pm n being on 5th floor stairs use, parents coming in, Lift usage all is making trouble to residents, as on other hand, we are staying at 1st floor, having 2-3 kids a batch our timings are also like 3-7 max, n no need for kids to use lift atall. still soc dnt want to listen anything.
n mainly ppl have complaint only about 5th floor classes as we did survey in our building n 14 flat owners signed even to support us to continue classes as there is no any inconvenience to them by our classes.
bt all that society dnt want to listen.

Your query does not seem to relate to any real problem.

However, you can't convert a residential flat in to a training centre. Earlier in reply to question, you stated that both the flats are 1bhk each. The question arises, in addition to your own living and daily household activities, how you can accommodate 25 & 75 students in 1 room set each of 10x12 sft?

Moreover, owning flats does not mean that you should cause nuisance for the other flat owners by frequent movement and noise of the 5th & 10th class students.

Dear Sir, Thanks for Revert... Sir, I mentioned I am at 1st Floor and our each batch contain 3-4 kids only, I said as a total they are 25 students for year. Every day we do have 2-3 batches having 3 to 4 students in each batch.
Actually there is no any problem to the society members, but the 5th floor person have more than 75 students comes in at different batch, his each batch contains 15-20 kids at a time. and thats causing major trouble to members.
and for that society tried to convenience him to stop activity, his wife takes these tuition and even she is a school teacher too. But he blackmailing society by pointing out on our class, as saying first stop this home tuition then only he will close. and for that society is forcing us to close down our home tuition. and Its purely Injustice. Home tuition is our need. Society members even support us, but society saying they are going to close down all commercial activity in society. Our society have 96 flats and In AGM 27 flat owners were present in that Voting happened & 12 Members were in support to run Commercial activity & 15 were against it.
But then to answer this, I wanted to prove my Home tuition is not a commercial activity. bcoz in a society, there is a Ayurvedic doctors clinic is also there, a registered Nursery also there. even 1-2 families are engaged in Garment stitching business too. So I mentioned if all are going to shut eveything then only I will think to close down,
Now on this I need your Expert way forward. Pls help

You will have to abide by the majority decision. If not agreeable, muster enough strength of membership to gain majority to change the management through another AGM.
