hma 24

(Querist) 27 July 2017 This query is : Resolved
respected Seniors pls ans me i hav filed divorce and wife has filed hma24, and got interm maintenance of 8000 frm date of application, I appealed in Calcutta high Court but got no change in order,
Now if i go for revision in high Court tht d maintenance shld b frm date of order only, is there is any chance tht i ll get success?
Ms.Usha Kapoor (Expert) 28 July 2017
If your wife is a mere housewife doing nothing court in its discretion may fix monthly interim maintenance taking all circumstances into consideration. Unless there is a change in circumstances such as your wife inheriting a vast property or getting a lucrative job your wife's interim maintenance amount of rs.8000 is not going to change.

no use of going for revision, better to concentrate your case in trial court.
Rajendra K Goyal (Expert) 28 July 2017
These are orders for interim maintenance, may not get desired results in revision.

You have been appropriately advised.....
