Wife create false reason residing separately and refuses to live with husband.
She left husband house and live with her parents 4month after come husband house and within a week file false reason in pariwar police paramarsh center there husband again go to wife house and carry child and wife from her parents house to own house. But wife again go to here parents home after live with 20day only stay with husband.

help me if she is win 125 so my child 1.4month and my life destroying. this is second time in my life turns.this is my second wife is towards divorce.
1- This, my marriage solemnized date 30January 2013 which is conduct accordance to Hindu religion & custom through concurrence of both family without any pressure.
2- This is my second marriage after successful divorce on 10 December 2012 by family court.
3- This, my wife is B.A. graduate and first night of marriage restrain me for sex and told please wait for 4 to 5 month for sex.
4- This, without golden night wife return to her parents house accordance to family custom.
5- This, wife forget her mobile in my house same day accordance incoming sms on wife mobile I realize and feel she is abusing me and I search then found who send sms in my wife mobile person name is not anjali2 this is “ Kohli” and daily open a hardware shop in my father-in-law house which is tenant deed with grandfather of wife, from 8 to 9 years, “Kohli” already a married person also two child.
6- this, my wife accept her mistake in-front of her parents and me, she told don’t talk to them, I love Kohli from 5 to 6year and nothing to go with wrong physical relation except lips kiss. And I swear from today no relation with that person also I forget them for always in life, and she asked me why? you destroy your and my life, then I told to my wife, why you hide this history before our marriage.
7- this, through concurrence of wife parents and my wife also take a oath without my permission, she will not come to her biological parents house without any reliable region and she always come with me and go with me without halting any night till the day tenant not out from house shop.

1. Yes, you are liable to maintain her and the baby. However, if you can prove her adultery, she would not get any maintenance.
2. Moreover, she would not stay with you as your wife, as per circumstances explained, therefore, plan for third marriage. Best of luck.

I do not find this marriage to work any longer, more so, when the wife is compulsive cheater.
Better make a n amicable settlement to move on in life.

husband should file for divorce on grounds of mental cruelty and adultery . gather evidence of her affair and file complaint of adultery against Mr Kohli

History :- 1st marriage run 5days only “she left my house in 3rd day of marriage and come after 20 days and again left 2nd day she told me she want study for her carrier and want stay with her parents home. That is my mistake! I don’t know but When she not come after select in bank job. So I feel she never ever come and file case RCR (Sec.9) then mutual divorce because no communication in 2010-2012 between us.
Jan-2013 I was remarriage poor joint family studying final exam B.A. private girl and first night of marriage she restrain me and told me wait for 4 to 5 month. Without golden night she return to her parent’s house accordance and behind to Hindu family custom. while she forget her mobile in my house same day accordance incoming sms on wife mobile I realize and feel she is abusing to hide her history before our marriage. But I try to live with a warning and within a month after our marriage my wife was pregnant and I think and feel now she would remove memory her lover who is already married and his already two child but I was wrong, after my child birth she left my house when girl child age complete 6 month in jun14. And come after 4 month oct14 with a plan, she give false complain woman police station. Then after complain I try solving situation love and carrying my child & wife but her parent’s not understand me she also left my house again with her parents and she try in legal procedure in last 3 months notice game after start family court 125 maintenance game.
So it’s clear she is never forget her love and she want money if she got it so never come with me and again I have only legal my right in law divorce.
My question can I file before my presentation in 125CrC I am going to file divorce 13(ia)?

You can go ahead with the divorce case but the 125 case has to be challenged based on the evidences and merits in your side.

my job was pvt so left it. some time i was going to destroy self, i have voice evidence but my lawyer told this was show on divorce case if she not ready to live with you.
i also told my wife if you want money so told me i will give as i give before total salary was my 20-25,000pm but now 3000pm because of intention of my wife and my child not come so what is my life meaning 2500rs is more for me. she is also doing work stitching and file case for money???
