Full bench reference

There are two conflicting judgements on single law point by two divisional bench.
What is the procedure for reference to Full bench in Bombay High Court.

Husband rights in 1st wife property after second marriage

Its my Maternal grandfather ancestral property .He died intestate in 1957 leaving my grandmother ,my aunt(1st minor daughter) and my mom(2nd minor daughter)
After his dismise revenue record got mutation to my grandmother name .My mom got married to my father in 1975 and she died during 1979 leaving me as her legal heir.
My father married 2nd time in 1982.
After death of my grandmother intestate in 1992 myself and my aunt family filed a partition suit and divided the land in 2014.
Presently my father's 2nd wife family is threatening me that my father have share in my maternal Grandfather(his Father-in law) ancestral property alloted to me by the court.
My father is still alive.
My queries are as follow:
1.After my grandfather death in 1957 ,the revenue record got changed to my grandmother name.As my grandmother died intestate Myself and my aunt became sole legal heir.How come my father can claim share?
2.Do my father have share in my maternal Grandfather ancestral property(his father-in-law) even after second marriage?

Issue with the college

Dear experts
I am a university student, in a final year,
my college university is not providing me my mark-sheet of 1st & 2nd semester, I have no dues pending and the university is delaying by postponing the date to issue mark-sheet,
What can I do as a student against the university? please provide me some legal steps against the university.

Error in exhibit no

1. Court clerk failed to maintain Rojnama in one civil suit for almost one year this I noticed last date , According to system they should write rojnama immediately on that day max to max next day. Computerized Rojanama too not maintained on E Court
2. I noticed from last few months he is writing Exhibit No. again that is we reached Exhibit no. 140 he started writing Exhibit no. 129 etc further marking on paper
3. Now from Exhibit No. 129 there are two paper in court brief

Q1 Whether Section 153 of CPC is correct provision to be used in application praying to court to rectify its record ?
Q2 In case order is passed whether Sec 152 of CPC is correct provision in which application is made or Section 153 of CPC too required

Writ petition

1) An eviction was filed in 2017.
2)Tenant Extent the property from Landlord portion and PWD land.
3)Lanlord file 144 , police did not came.
4)Landlord filed RTI to PWD . PWD reply , such no permission was given and advice to do a police complain.
5)Landlord send Municipality to demolish the illegal portion also.
6)Tenant enjoying the extended property.
7)Lanlord mention that in the Eviction suit .
8)In the Suit ,Tenant mentioned that , the portion is on PWD area, not
Landlord area.So , the eviction suit has no connection with Extended portion.

Landlord want to demolish the illegal area

My question is
1)Can I file Writ Petition to demolish the illegal portion in Hight Court ?
2)Will High Court accept the Case while litigation is pending in the Lower Court ?
3)Is there any legal remedies , to demolish the illegal area ?

Have kharedi khat but agent/developer not giving 7/12

Hi Experts,

I have purchased a land near pune and did the kharedi and paid full amount to the Agent/Developer. Now the are not replying and also not giving the 7/12 utara. Please let me know who to obtain the 7/12 using Kharedi Khat.

Pagadi property purchase by third party in mumbai

Sir,
Want to buy office room in mumbai under pagadi system. I understand they will issue rent receipt in my name. Now i need to know the details and legality of transaction.
Modus operandi, : any documents to prepare other than rent receipt ....and need to be registered ... any guideline value.... payment to pagadi owner or to both pagadi owner and actual owners? stamp duty/ taxes to be paid for the same..... whether legal ?
After transfer of rent receipt in name of purchaser can new pagadi owner sublet the property ? ....can he resale also with profit/ losses ?
can he be evicted on ground of not using the premises ? in case of redevelopment whether new pagadi owner need to pay redevelopment charges for 240 sq feet room ?

Land survey

When I applied for survey of my agricultural land to determine boundaries and the govt surveyor give notices to the owners of the adjacent land to attend the survey on the scheduled date and if they have not turned up, what will be the repercussions? Shall I proceed to survey even without attending the owners of my adjacent land? Please give proper suggestion

land acquisition

my friend lost a case in land tribunal immediately the name of the persons who won the case were entered into rtc and the land owners who lost the case went to high court meantime the land was acquired for the formation of layout and the persons who won the case collected the compensation from the concerned government body later the persons who won the case in land tribunal lost the case in high court the layout is formed and houses have been constructed can we get some other land against the acquired land because we have not received any compensation the other party had claimed the compensation
