Termination laws

On 16th August 2017, after successful completion of almost 20 years of service with an educational institute, my brother has been served a notice to discontinue his services with immediate effect. Firstly he was asked to resign and on his refusal to resign, they initially threatened him to terminate. In 20 years of his services there was nor a single complaint about his behavior or performance.

Please advise if it is legal to discontinue services of any employee? what action we should take against such practices.

Compansation & claims after loosing of right hand

Hello there,

My father was working in a factory & accidentally he lost his right hand while working on machine. The e'er paid for the treatment done in pvt. hospital & now we are looking for esi pension but it will take approx 6 month or more as advised by a doctor at basaidarapur hospital.

Now, the point is e'er is saying for the payment towards compensation approx. 2 lac. & also he is saying the he will keep continue my father's job in his company as soon he will get well.
at the time of incidence we did not call the police or put fir but the police was called from e'er side.

but we are in afraid that there is nothing in written and it's been 2 month almost & my father has not received any compensation.
E'er is saying that he will pay in 2-3 days and so on.... Actually the case has been transferred to TISHAJARI court & there has not been judgement till now but we did not file any sue, or case against the e'er.

now what shall we do???
we should wait for the judgement? we should believe the e'er? we should make any case or go to police stn.??
and one more thing what shall be the total compensation in this case?
my father was working there for 25 years.

please help anybody.

Fradulent document cancellation by the registration authorit

My brother declaring a false statement before sub registrar created fabricated documents and grabbed my share of property. His declaration before the authority is that he is only son of my father where as we are three others. Since he has given a false declaration before the govt.authority can I request the registration officer to cancell the documents under sec 82&83 of the registration act.

Termination in probation period

Dear experts,
Could you let me know whether a employer is terminating a employee on probation period without giving any reason and sudden is correct in spite of employer is ready to give the one month salary as lieu of notice as per the appointment letter in probation?

Somebody can help me on this regard.

Appointment on compassionate ground

My father was working in BSNL Ranchi. He died on 03.03.2014. l got married on 13.02.2011 I.e. before father's death. In spit e of marriage I still residing with my father since marriage. I am facing conjugal right case launched by my husband before my father's death. Know I want to apply for appointment on compassionate ground. Can I apply and got appointment?

Company not paying the settlement

Dear Experts

The company I have been working for last 12 years have been closed suddenly. They have not paid the pf dues to the government and they are remaining silent on the pending salary and the gratuity settlements.
Can any one guide us as to how to proceed on this

Query on high court judgement

Sir, I want to know whether a High Court of one state should give judgement in line with the judgement given by a High Court of another state on a similar type of case when the earliest judgement is referred to the judge by the lawyer?? (I request Sri P S Dhingra not to reply Please..)

Issue with my notice period

Hi,
Iam mohandas. Iam currently working in an IT company..i joined the company on 10th nov 2014 in chennai location. On joining day,i was not given any appointment letter but the company hr had me sign a bunch of documents and also took sign on the offer letter copy which i had carried. When i asked about appointment letter, the hr told me that i would be given appointment letter after 1 month of joining. I met with an accident on 4th dec 2014 and didnt go to office from then.i notified the company about my accident the same day.i recovered well by january 25th 2015.my family is based out of bangalore and my work location was chennai. After accident,i couldnt bring my family to chennai as we have a premature baby(born in dec 2014 in his 7th month) and i had to be with him as he had lot of complications.
.after serious consideration about my future ,i opted to look out for job oppprtunities in bangalore and hence informed my company that iam resigning. I have a 2 months notice period clause in my offer letter and i requested the hr team that i will pay out for my notice period amount or in worst case i would serve my notice period by doing work from home(from bangalore). The company took back the company laptop and all other company assests from me. After taking the company assests now the hr team has sent a notice to serve 2 months notice period from chennai location or legal action would be taken against me.
I spoke to hr team couple of times on the alternatives but they are reluctant that i have to serve notice period from chennai location.

I have couple of questions here.
1.i was not even given the appointment letter till now..is the company doing the right thing to force me to serve notice period from chennai location

2.what legal actions the company can take against me as iam ready to pay out for notice period or ready to serve notice period from alternate location.

3.can the company in first place deny my payout offer and force me to serve notice period

Notice period waiver

In my friend company , notice period waiver given for earlier sales manager for two month , whereas my friend has given notice period of one month who is just join as a sales manger replacing earlier sales manager . Company is saying that it is as per discretion of mgt., waiver is giving by company. My freind want two month waiver in notice period . How can my friend request is tenable. Noting is mention in the appointment letter regarding waiver of notice period and companies policies .

HR head and company senior is just giving him false reply?

Query regarding agreement between employer and me.

Dear Sir,
I have signed agreement with my company for 3 years. In this agreement no clause in my favor of me. That means this agreement is all in favour of company.
Now after two years when I want to switch my job, they are asking money from me as per signed agreement.
If I will not pay the same they will not do any final settlement.
And this amount is much bigger than te money I need to pay to company.
Please let me know if I don't pay this money as per agreement then can I claim for full and final payment to company or not?
