Banking regulations for housing cooperative societies

Learned Experts

Banks do not accept online/neft transactions for housing cooperative societies. It is always and at this hour of crisis difficult to operate bank accounts and make payments by cheques or cash. Appreciate guidance as per banking regulation RBI with any notifications to faciliate

Election holiday

In view of the specific circular by the Labour Department mandating paid holiday for employees (other than exempted establishment/industry), can any establishment, within the Airport ask employees to work. While Airport is exempted, will a commercial establishment, say a cosmetics sales counter operate with
an employee without providing him leave

Omission to pay 1st month's salary

Dear Experts, I have a query for your valuable opinion. An employee joined in February and the appointment was sent by post. He joined in Feb, but returned the letter duly signed in March, mentioning the date in March ( one month latter). During data processing, the date of joining was entered as March and hence no salary was paid for Feb. The matter was raised by the employee by pending resolution. This month's salary has to be paid in Nov as arrears. What will be the implication for EPF AND ESI.

Retirement age

Can a organization fix a lesser retirement age say 45 for its employees in executive and management cadre.

Division of monthly wages & salary

Learned Experts, Considering the Payment of Wages Act, Weekly Holidays Act and relevant labour laws, a daily rated workmen is entitled for 7 days wages, if he has worked for 6 days in a week (if wages are paid weekly) AND 30 days wages, if he has worked for 26 days in a month - month being the standard number 30 days. Premised on this law, the Payment of Gratuity Act provides for division of the monthly wages by 26, for determination of gratuity payable - 15 days per year. Accordingly for determination of leave pay (privilege leave) the monthly wages/salary should be divided by 26 AND not 26. However, many industries, particularly FMCG uses 30 as a divisible factor for leave pay, for it managerial employees. Whether this is justificable - Please advice

Exchange of allotment

A Society in Maharasthra promoted by us 12 years before - property is CIDCO leased one in navi mumbai, construction was done by a developer under tripartite agreement- CIDCO, promoter members and the Development. Initially allotment letters were issued and later certain flats were exchange informally. I got my flat exchange for another flat.Although every transfer needs CIDCO approval this was not done. Now the society insist on regularization. Does this exchange attract stamp duty - would CIDCO ratify this. The exchanged flat has been sold and I cant track the original allottee. Now that the matter is old and no issues, CAN the society accept our explanation and keep quite!

Motor accident

At a interjection of a road, I was driving straight and a bike passenger driving fast stumbled on the car and fell to his left. He was on a friend's bike, (no insurance) and got injured - because of bad skid and fell on the road. I have taken care of the medical emergencies and offered to get a formal police complaint to facilitate insurance claim. However, the injured persons and the owner of the bike have no interest (he would get the claim due to lack of insurance) and plead for settlement of medical expenses. I intend getting a disclaimer from the person that there would be no further claims, once the medical treatment is taken care. Would this be fine.

License for storing Acetone (commercial) Small Qty

I understand that the storage and distribution of petroleum products are regulated by Petroleum Products Act and for solvents like ACETONE is governed under the Inflammable Substances Act - Under this Act, certain notifications issued under the PP Act applies to the solvents - Under what class (A, B Or C) of the Petroleum Products Act is the Acetone classified. We have a godown where we want to store small qty of around 100 litres (commercial grade, for use as nail polish remover), in transit for supply at our customers retail outlets. WOuld be obliged for expert's guidance on this!

Employees Compensation Act (WC Act)

Learned Experts, Can you please enlighten us on one doubt. we are a small company covered by the S&E Act and in MAH, EC Act is extended to employees of the establishment! We have covered all employees with personal accident policy for a lumpsum, premium paid by co.(employees are above ESI limit). In case of accident arising in the course of employment would the policy settlement by the insurer would suffice compensation or we haveto pay as per EC Act. If we have to pay as per EC Act, can we offset the insurance policy amount from the actual compensation payable as per the EC Act.

Employee's Pension Scheme Widow's pension

Dear Experts, The EPS Nomination provides for children pension, widows pension and for widows pension - two columns. One for nominating a member's wife's name and another, in case the member's wife is pre-deceased, to provide for any other family member. Query: Can this nominee be any person including his mother/father. Query 2: Can an unmarried person also nominate a family member for this widow pension! Query 3: Now a days, Company's have pay cycle, usually by 20th of a month and if a person joins on 20th or thereafter, his pay is paid as part of the next month's pay roll - is it sufficient compliance for PF Act. Also if the new employee in such cases dies before the 1st EPS contribution is remitted, would his widow be entitled for the pension benefit. Thanks.
