Construction of building on non-partition land

Sir,

A and B are owners of land having share of 75 : 25 ratio.The partition process is not started.

In this case A want to construct shops on share of land but B is refusing for partition of land.

Please advice 'A' on the following

1. Leaving 25% of land as vaccant(B's share) and construct shop on balance 75% of land (A's share)

2. If case 1 not feasible what is the solution.

Do i need to pay vat now?

Sir,

I booked flat in pune on 13/8/2010.
i got possesion of flat on 12/10/2010.
As per new law for VAT, builder has to pay a vat of 5% if flat has been booked in beetween 20th june 2006 to 20 th june 2010.

As i have booked my flat after this date period, is above law applicable to me?
do me or my builder has to pay any vat?

Please help. little confused.

I married again couple of years before. Could you please explain me how can i divide my properly amoung my 2nd wife and childrens as per muslim personal law. I mean the ration of division...

Little confusion regarding my name in certificates and other cards.

Sir my correct name is TINKER MAHAMMED MUNEER BASHA, where surname is TINKER, first name is MAHAMMED MUNEER and middle name is BASHA. And my father's name is TINKER MAHAMMED YUSUF.

So it's generally written as MAHAMMED MUNEER BASHA TINKER. But in my SSC it is as follows. TINKERMAHAMMED MONEER BASHA. There are two mistakes, the first one is there is no space between TINKER and MAHAMMED and the second one is a there is letter 'O' in the place of 'U'. And my father name in ssc is as follows TINKERMAHAMMED YUSUF, here also there is no space between TINKER and MAHAMMED.

Where as in my Intermediate and degree(B.Tech) certificates it is as follows.. TINKERMAHAMMED MUNEER BASHA, here there is ONLY ONE mistake that is there is no space between TINKER and MAHAMMED.
and my father name is as same as it is in ssc certificates.
I however was able to made residence certificate, date of birth certificate, pan card and driving license with my CORRECT name. Now I've to apply for passport, they are asking my given name and surname. So my questions are

1> Is the Space really matters?

2> What I've to do with one letter mistake in my name(MONEER in place of MUNEER)in my ssc certificate. Is one letter really a major name change?

3> Will these errors are consider as serious by passport officials? Could a simple affidavit, suffice it? or Is the mistakes a real issue?, is there a simple way to resolve this ambiguity?

Section 154

What is the time limit u/s 154 of rectifying the details provided in the income tax return? In our clients case there is no demand by the department in the intimation issued u/s 143 but we have failed to claim the TDS so can the refund be claimed by filing the rectification?

Naya raipur land aqusition

Hello Sir,

I own a small scale industry in Naya Raipur (New Capital area),which is getting aquired by govt to make educational complex area, i have been working here since 1996 with arround 20 labours and i got started this factory after CSIDC (Chhattisgarh industrial development corporation) and my land is also diverted with govt norms.

Looking into future growth i have taken a handsome loan from Nationalised bank after putting my land paper as mortgage.


Govt has decided to to pay some small amount as a compenation ,which is quite below the current land rate , which dosnt allow me to start somewhr else too.
[starting new place will mean new land rate + establishment cost + 1 year duration business loss]

Please help us how can we stay thr and run my and others livelyhood.

Looking for help, this will save several life...

Legal opinion for purchase of bigar gunthewari residential properties in pune

I am willing to purchase bigar gunthewari residential properties located in Dhankawadi area, nearby lokhande bridge, pune-satara road, Opp. bharati hospital, pune. In that building, there are 12 flats situated in all 3 floors amongst which one has done gunthewari 4 to 5 years back. Right now, gunthewari has been stopped in Pune. I have some issues for which I seek legal opinion for the same from your point of view are as below :-
1) Whether bigar gunthewari residential properties needs to purchased which is 22 years old.
2) Nearby that area, flyover work is going on, what needs to be checked from PMC for the same.
3) What documents needs to be derived for getting me clear title of the residential property.
4) Whether I can get the housing loan against such properties in Pune?
5) I am purchasing the property from the 2nd owner in which 2nd owner doesn't have original documents of the 1st owner for which he has taken all certified documents from duyyam nibandhak karyalaya. Not being relieved from services

Hi,
I am a confirmed employee (Manager) of a Pvt Sector Bank, as per my appointment letter quote " Incase u decide to leave the banks services after confirmation, u will be required to give a 90 days notice period. The bank in its sole discretion can decide to waive off/reduce the notice period depending upon the exigencies. In such a case you will be required to pay the bank the gross salary for the notice period so reduced/waived off"
I have got a job in the media industry, something that I have been pursuing for almost 5 years now. My new company has asked me to join within a months time that’s in mid june, I had tendered my resignation exactly a month earlier thats mid May. I have explained the entire reason for leaving and what the new opportunity means to me, but the Banks is just not letting me go.
Earlier in Jan this year I had tendered my resignation but my immediate superior had rejected my resignation, I still persisted and again he rejected my resignation, verbally stating that my resignation at this juncture of the financial year will affect the year end ratings and if I tendered it in April he would assist in getting an early relieving. Hence my resignation was not accepted.
Now that I have resigned, he has accepted my resignation, but since its all system generated, the last working date is mid August. He has now washed his hands off and states that I would need to seek approvals from the Sr Mgmt (Bussiness or HR)
I have followed all protocol, requesting an early relieving, right from my super boss to his boss. Now I am interacting with the HR team and the have stated that early relieving is not possible and I wud need to serve the notice period, finally now I have sent a mail to the GM- HR requesting for an early relieving but there’s no reply.

I had requested that I would serve a 1 months notice (Of which 2 days are remaining) and I would pay the bank 2 months gross salary (this I have mentioned in all communications), I have also provided the bank 6 to 7 suitable candidates for my position (Product and Designation specific) but they are just not willing to let go.

Since there are 3 days left, I have completed all handover procedures, online as well as where my profile is concerned, I have also verbally informed my immediate superior and my super boss that I will not be coming into work from mid June.

Post my resignation, I was also promoted as a Sr Manager, and now they state that since I am a Sr Manager, finding a replacement is difficult.

Seeking advice on how should I proceed with this, I have decided to stop going to work from mid June and send an mail to HR stating that I will not be coming into work and request them for one last time and also offer to pay the notice period amount of 2 month.

1) Can the bank terminate me under the absconding clause?
2) Do I inform my new employer about my situation and would they take it negatively?
3) During a verification check, can the bank state that I am not relieved from services and hence in clauses of dual employment I stand to loose the job.

(Please note that my new employer has agreed to give me an additional 15 days more to join them, but if the bank is not going to relieve me of my services then why should I wait for more 15 days, I might as well join them earlier)

Orignal property documents stolen

Location : Bangalore

Respected Sir,

I wanted to sell my property and had advertised it in the newspaper and one person called Mr.Manjunath had called me and suggested that he was interested in buying the property, he asked me for the photocopies of the property document and when i provided him the same , he came back saying that as the photocopies are not clear he wants to have originals which he can get it photocopied. As a matter of trust i met him and his brother and provided him the originals which his brother took to get it photocopied, in the meanwhile Mr.Manjunath took me to have tea and while we were having tea, Mr.Manjunath got a phone call and told me that he will be back in 5 min and thereafter he and his brother disappeared with the original documents
All the original documents of my property have been stolen. I have taken the below steps

1) Put up a notice in a local as well as a nationalized newspaper that the orignals documents have been stolen.

2) filed a complaint with the Police and pushed to file an FIR which they are refusing.

3) Filed a PCR case in the civil court asking the court to force Police to investigate the matter or file a FIR against the thief(Mr.Manjunath) who is untraceable now.he mobile no. is also switched off.

4) Taken all the certified copies of the documents.

My questions are

A) Is there anything else i should do in order to safeguard my property.

B) what is the best way to get the original documents again as i really want to sell off the property and the customers really ask for the original documents.
