Credit Card Dispute.

Dear Learned Friends,

Subject to your time, convenience and availability, please advise me on the following :

Facts :

A friend of mine was using SBI Credit Card and due to deficiency of service by the bank, settled the card account by reaching one time settlement of Rs.41258/- as advised by the bank official. As advised by the bank official, amount was paid in two installments and thus, the account was settled on 26.03.2004 (i.e. 2nd installment cheque date).

As my friend was not aware of the bank’s settlement procedures, neither he did collect any specific letter for the one time settlement nor did the banker provide the letter. Thereafter, my friend did not receive phone call from the bank and nobody visited his residence / office.

After 18 months, the bank’s advocate sent a letter under instructions from his client to make a sum of Rs.15,661.83 as on 22.09.05.

Immediately a suitable reply was sent to the Advocate explaining the facts. Thereafter, there was no reply from the bank’s Advocate.

My friend concluded that the matter has been treated as CLOSED by the bank, as there was no call from the bank.


Now, the bank is insisting to make payment (which is not informed), otherwise, the action shall be taken against my friend.

Query

Based on the above facts, what merit available to my friend and how can he establish that he has reached one time settlement (and already made the payment) in the absence of letter.

What action can the bank initiate against my friend for claiming INAPPLICABLE AMOUNT for the already settled card account ?

Unable to withdraw PF

Hi,
I am unable to withdraw my PF from my previous company, firstly i sent the duly filled withdrawl form and couriered it but after 3 months when i followed up with Finance dept they said that it will take sometime but later they said that i have not filled a form due to which it came back when i asked which form the accountant did not tell anything and when ever i call them or email there is no response.

I sent the PF withdrawl form duly filled on Dec 8th 2009 and enquired about the status in March 2010 but after that there is no response.

Kindly suggest how to proceed and withdraw the money, i worked in that company for 16 months and had asked to quit because of recession in 2009.

Default in Co-operative bank Loan

Dear Sir, My mother started a shop nearly 10-12 years ago who was the member of co-operative bank & took a loan(Jaat Jamin) of Rs. 39900 on 1/12/00 @ 13.5% of interest rate to be repaid in 6 monthly installment of 6650 + interest.. Within 3 yrs she paid Rs. 21400/- & Rs. 3000 on 15/09/06 & Rs.5000 on 23/7/10 (Total Rs.28400).. We closed the shop in 2004 due to loss when she informed to settled the loan account but they did not responds..
She went 2-3 times for settlement but they used badwords & insulted her hence she stopped visiting bank. Further we just got 2-3 notice regarding payment of loan from bank but not a single notice regarding settlement of loan. Now after many years they came back with statement which doesnt show any amount deducted from Principle amount & asking for outstanding Amount of Rs. 80,334/-..Or else they were asking to pick up all house hold goods which are mostly purchased by me.
Pls. advice on these. Are they authorized to take goods of mine ?
Pls. pls. advice me so that we can clear out this matter.

aquiring details of Bank deposits

I am a married woman of 57 yrs age.My Father died intestate. I had a married brother who died leaving behind his wife and 2 minor children. I also have a married sister.Father left lot of property and Bank deposits, the details of the deposits are not traceable or the bankers wont divulge. There was no partition. How to get details of Bank deposits legally ?

Arbitration

The legal requirement in cases of Arbitration.

Husband is an advocate wife a law graduate with bank experience. Husband is legal counsel for the company. Can wife be appointed Arbitrator for the proceedings of the company. Is it legally valid. Under what circumstances it can be done. Is there any legal bar to the appointment.

at his/her own peril”

Can anyone clarify as to under which law or laws of India it is settled so?

Personal Loan

Sir, I am running a business on a small level. In Dec.2007, I had availed few loans from different banks Rs.3 lacs (with EMI 9500/- approx) & Rs.2.5 lacs (with EMI 6000/- approx). In 2008, I paid my EMIs regularly. But last year, I could not pay my EMIs regularly due to heavy loss in business. My business is not in a condition, bcoz of that I unable to fulfill my commitments.

Yesterday, I received a call from Bank/Recovery Agent that they have arrest warrant against me and shud pay entire amount or face the consequences. I told him about my current situation but he expressed his helplessness in this regard and told me pay the entire amount. Entire amount is possible in this current situation, even last year I had to sell my wife's jewellery and deposit the few of the EMIs in the hope that maybe my business condition will improve, but it does not look so. I dont have any property or asset to sell else I would have done that and returned the amount of the bank.

I am not a criminal and sincerely want to pay the money, which I availed from the bank. To fulfill my commitments, I am even trying to get a decent job but becoz of my low qualification, I am not getting job offers more than Rs.8000/- salary. I really need is some time, until I get a decent job. And even if I get a job, I can't pay the same EMI Rs.9500 + Rs.6000/- when I will be getting Rs.8000/- a month. I dont know, what should I do?

Is it possible for the Bank/Court to lower the EMI or instead take the installment quaterly which I could easily pay.

Can someone please guide me in this regard?

related to car finance

Some people from car finance company came to our house to enquire about my sister. she is married and had car. they are taking advantage of relation and making scane. they are coming to my house in 10 t o 12 numbers and making scene every time. what should i do. I dont have any relation with my sister & hasbant as far as money concern.

Security Deposit

Dear All,

I am planning to take residential flat on leave and license agreement, i have following query
1) Can i enter into 36 months contract?
2) What is diff between Lease and leave & license
3) Flat owner gave me following 2 option for compensation
a) Rs. 7 lacs refundable deposit + no rent
b) Rs. 10,000 Rent + 1 lacs S. deposit,

If i opt for option no 1 then what precaution i have to take or which clause should i write in the agreement which will safeguard my money in case of owner solvency or bankruptcy.
