Registration of flat owners association

We are residing in an apartment in Tamil Nadu and we have registered the association five years back. After that the Committee members have not renewed the regn. every year. Now what is the procedure, whether to renew or to register as a new association. Kindly clarify.

Family pension

I am a Railway Pensioner. My wife has not changed her initial after marriage and keeping her father's name as initial in Voters ID, Driving Licence, Bank record etc. Similarly in my Pension Payment Order and in pension paying bank, her father name's first letter stand as initial. But in her aadhar card, my name is there, since it was told only husband name should be in the back. At the time of my wife getting family pension whether this will create any problem kindly clarify.

Compensation to accident victim

There is a saying "If a person dies in a Motor vehicle accident, there is a Supreme Court judgment under MV Act 1988, that if the victim is filing ITR for the last 3 years, Govt. should give 10 times of his 3 years annual salary, as compensation." Is it correct. Kindly clarify.

Special GB meeting of flat association

Our flat association in Trichy has fixed Special meeting for collection of excess maintenance amt. They haven't advised in writing and instead pasted in Notice Board, informed through phone & whatsapp. They have given only one week in advance. Is it correct and legal? Kindly clarify.

Flat maintenance amount

I have given a flat for rent. Both the owners and tenants are paying equal amount of maintenance. Now without calling the flat owners who has rented out the houses, they have conducted a meeting and decided that the flat owners who have rented their houses should pay Rs.1000/- for each quarter, to meet out the association running expenses. Is there any rule like that. Kindly clarify.

Member in Flat Owner Association

We have registered our Flat Owner Association under Tamil Nadu Societies Registration Act 1975. Is there any restriction that one EC member can continue for certain period only. If so, kindly indicate relevant section under Tamil Nadu Societies Regn.Act. kindly clarify.

Flat owner association

In our apartment in Tamil Nadu, Flat Owner Welfare Association has issued a circular that when the house owner gives his house for rent, he should inform tenants details to association and after getting their permission only they can give for rent. So far we have given tenants details to association after renting out only. But there is no mention in the Bye-law regarding getting permission. Is it correct that we should get permission of association, for renting our house. Kindly clarify.

Corpus fund of Flat Owners Association

We are residing in an apartment in Trichy, Tamil Nadu. Since, outside and inner painting of our apartment has to be done, some people are telling we can withdraw from corpus fund. They are telling it is very difficult to collect from the flat owners. It is mentioned in Byelaw that interest of that fund can be utilized for maintenance. Nowhere it is mentioned that corpus fund can be withdrawn. Is it correct to withdraw from corpus fund. Kindly clarify.

Painting of rental house

I have occupied a rental house in Trichy. House owner has painted nearly half portion of the house and other half was painted at my cost. I have provided split AC in the hall by opening a small hole. Now when vacating, I have properly closed the hole with white cement . There is no mention in agreement that I have to paint when vacating. Owner asking me to paint. Is it correct , since for normal wear and tear, tenant is not responsible. Kindly clarify.

Rental agt

I am residing in a rental house in Trichy. My house owner is refusing to sign Rental Agt. & even refusing to give receipt for the advance recd. Several times I have reminded her through phone, SMS and WhatsApp. What is the solution? If I stress for Rental Agt. whether she can force me to vacate the house. Experts may kindly clarify.
