Cheque stopped from payment

Querist : Anonymous (Querist) 24 June 2010 This query is : Resolved 
I had stopped a payment. Subsequently I was summoned by the magistrate. I appeared before the magistrate to whom I said that I am not guilty.

He gave another date of hearing on which I appeared but the magistrate was absent. I was given another date by the staff.

I shall not be able to appear on the date as I have got a new job and hence will be moving to another city.

Kindly advise as to what should I do.

If you have engaged lawyer to plead on behalf of you, he can seek exemption. You can seek. Try to plea before court that stop payment is not covered under Sec 138 NI Act as plain reading of the section or ingredients of the offence.
