change of name

Querist : Anonymous (Querist) 20 March 2010 This query is : Resolved 
mR. XYZ, who is a MALE by gender, passed his LLB exams, but did not join the Bar soon after passing. In the meanwhile, he changed his COMPLETE name from XYZ to ABC. nOW bAR COUNCIL objects that only female have the privilege to have certificate with maiden name and join the bar with name changed on marriage. can BAR COUNCIL refuse license to a male on the ground that his name in the LLB certy is different from the changed name as appearing in the Govt. Gazette?
Does anybody knows any ruling over the change of name matter which shall fit to this jigsaw?

I don't think that should be a problem with BCI, the grounds of rejection has to be ascertained.

Better you ascertain with the officials with the Bar council and get the order of rejection in writing and then proceed.

Changing his name is one's birth right. BCI cannot come in the way of it. After graduation, if XYZ has changed his name to ABC, he should have followed the procedure laid down thereto. XYZ should have declared by an Affidavit that he has changed his name to ABC and that affidavit should have been notarized. Change of his name should have been made public by an advertisement in a leading local newspaper.

If this procedure is followed and proof of change of name namely certified copy of Affidavit and original newspaper cutting is produced to BCI, change of name would be considered and would be enrolled in the bar by new name.

In my view you will have to go for change of your name in the educational certificates. Go to your concerned institute and apply for change of name in edu. certi. from 10th to L.L.B. This is the only way and you will have to follow it, (There is a procedure to change name in edu. certi. the concerned authority will tell you abt that procedure)When you will got all your edu. certi. in your new name then you can go to B.C. for regn.

Bar Council will agree if you will have to satify their requirements and that also follows their procedure for change of name.

The question is when women having XYZ name certificate are admitted to bar with ABC name on marriage. There is no law which recommends change of name on marriage. There is no legal prohibition to change name if one desires to do that and the freedom is irrespective of caste, creed, religion, sex.

Yes. Mr. Anonymous, All the learned experts have opined that like a woman, a man is also entitled for change of name. Both of them will have to follow a procedure for change of name which may include publication in newspaper, gazette etc. and if thereafter application is made to the Bar Council for recording of that name, the Bar Council cannot refuse. In case of refusal, legal proceedings can be initiated.
