Leave and license

(Querist) 08 December 2018 This query is : Resolved
Do I need to share copy of my leave and license registration copy to my society. I had not submitted the same and as per rules passed in the Iast AGM they have fined me 5000 for delay in submission.

Also they were threatening my tenant that they will call The police as according to them she was staying illegally, which is really absurd.

I also wanted to know if this can result in
to police action.

Kindly help.

Regards

Submit copy of leave and licence and finish the issue. Police may take action on society's complaint.

You are bound by the rules, regulation and Bye-Laws of the Society, so you have no alternative but to submit the document of Leave & Licence so that the MC can recognise the occupant as your tenant.
What is your reservation in submitting a copy of agreement to MC ?
Consult a local prudent lawyer for better appreciation of facts and guidance.

If you are from Mumbai or any place in Maharashtra, you are bound to comply with bye law 43 in terms of which you have to inform the Society 8 days before letting out the flat on leave license basis or care taker basis etc and file copy of the agreement with the Society. Further you as land lord is expected to inform the police about the details of the tenant and file a copy of the agreement with the police and submit to the Society copy of such intimation duly acknowledged by the police. As regards the penalty imposed on you, it is necessary for the Society to issue notice of breach and call upon you to rectify the breach - vide Bye law 165 (a). If they have not followed the above procedure, the penalty imposed is illegal and you can appeal to them to cancel the penalty.

Experts have suitably answered your querry. Nothing to be added. Any how, if you are under the purview of your society, you should bound the Rules and Regulations of the Society.
