Cancel sales agreement

Sir, I am from Tamil Nadu, my mother in law plan to sell land on 2010. And they made a sale agreement with one buyer for 11 months. Total land worth is 7.5 L , they gave 7L but within 2 weeks buyer is not interested and we returned the money to buyer. But my mother in law forgot to clear the sales agreement.

Now that entire is available in EC. How can I remove that entire. While checking with old buyer, is not ready to come to sub- register off.

Please tell us what is the procedure to cancel sale agreement which is registered. How to cancel it from encumbrance certificate

Dear Sir,
Get issue a legal notice to old buyer to send NOC having no objection to delete such entry since his sale agreement was already closed by returning entire amount failing which say that you will take civil and criminal action against him as he allowed the entry to continue even after closing the agreement.

Better not to disturb the Buyer and giving him a chance if his mind is corrupted. please keep your refund details etc safely. Any sale agreement would have legal binding for 3 years only Now almost 8 years completed.

The Sale agreement it self would have stated about cancellation and forfeiture and you could publish an news paper advt regarding it in local news paper and discuss with local Advocate

Your Mother could also execute an "Settlement deed " in your favor at concerned Registrar which would be very less expensive and would sort out your doubts. Discuss with senior document writer at concerned Registrar Office

Contact, consult and engage a local lawyer to issue legal notice qua cancellation of Agreement to Sell followed by institution of declaratory suit (if required).
