Repair work in flat system

respected sir,
i am in first floor, above my house one flat same size , from his bath room , toilet out let water leakage to my ceiling,
now the owner is staying some where in the local area he let out the house , the tenant saying that , this is not our problem you have to spend for repair work the owner of the property is not responding . day by day the wall and beam is getting wet more than 90 days . how to solve i am not interested to fight and legally how to claim

can we make any complaint to police station or any govt office to high light the toilet outlet water leakage problem (it will create the infection to our children's)

Submit a written complaint to the owner of the flat above yours and endorse a copy to the Managing Committee of the Society. You can also submit your complaint to the Municipal authorities.
