Is dv case with medical certificate ( fake) a civil case or criminal case. What if medical crtfcte just have scratches , inflamation remarks. Can dv case proceed to imprisonments?

Dear Sir,
It is a quasi criminal case. DV Act is a composite Act for married woman to claim 101 reliefs but the provisions being therein are misused by them. In rarest of rare cases a conviction will be recorded in DV case. In your case the medical certificate discloses only abrasions as such it may not ended in conviction if skillfully handled during cross examination of the victim.

For appropriate guidance, better discuss the case history of the case. So far as the medical certificate, whether fake or real , that has to be proved or disproved in the court of law before the judge of the case, not to be assumed by the opposite party.

If an applicant submit an application for medical certificate then IT is duty of applicant to submit legible application/anexures and keep the certificate clean/legible.
The document that is old/soiled have scratches may not necessarily be fake.
However upon complaint/inquiry IT can be found the certificate is fake or genuine.
What exactly do you mean to convey from inflammation remarks?
Do you meant that medical officer has mention inflammation on body of applicant and noted in medical certificate?
Creating fake document is fraudulent act and submitting fake certificate is in court of law may become fraud with court.
