Tenant not vacanting flat

I have made registered tenant annual agreement before 5yrs and have not renewed, now on rent I had hot discussion with tenant before 3monthd and he is not giving rent neither vacating.
What legal action I must take.

Supreme court in the following judgment have issued guidelines for landlord and Tenant agreement.
It asked the tenants to pay up every charge accrued on the house to enable the landlord get the rentals without any deduction.
NEW DELHI: The Supreme Court has drafted a model landlord-tenant agreement promising tenants five years of peaceful stay in the premises if they give rent at market rate, increase it by 10% every three years and pay the property tax for the house.
It asked the tenants to pay up every charge accrued on the house to enable the landlord get the rentals without any deduction.

I totally differ with the view of Ms. Usha Kapoor, as the querist has asked what legal action he must take to vacate his flat, not intended to revise lease agreement as per the model agreement suggested by the Supreme Court. Repeatedly sticking to her view clearly denotes that she could not understand even the meaning of the query.

Repeatedly sticking to her advice has no relevance unless she justifies why the querist should be compelled to remodel his agreement, instead of getting her flat vacated from the tenant.
