Advise with regards to a Mhada Property

Yes! As per latest rules you need not wait for 5 years mandatory period. You can purchase and rent out a Mhada property or flat.
MUMBAI: At a time when prospective buyers are searching for that elusive affordable home, the Maharashtra Housing and Area Development Authority (Mhada) on Tuesday relaxed rules, allowing lottery winners to rent out their flats. Till date, Mhada rules restricted lottery winners from giving their flat on leave and licence (L&L) for five years after getting possession.

The decision to relax L&L norms will benefit a majority of over 5,000 winners of Mhada lottery in the past three years. Depending on whether the flat owner belongs to the economically weaker section or higher income group, Mhada will levy payment ranging from Rs 2,000 to Rs 5,000 for giving its no-objection certificate to rent out the premises for 11 months. Such flat owners will have to also submit a copy of the L&L agreement to Mhada.

According to a senior official, "If an allottee is transferred to another city, he/she may want to rent out the flat. With restrictions lifted, there will be no question of illegal renting."

Therefore, your answer which is in relation to renting has no relevance to the query.

Let the client decide. Who are you to play spoil sport in my answer.I said he need not wait 5 years to buy or rent the property which was hither to mandatory and once possession is obtained title will pass to him or one who acquires Mhada property.Copying this why don't you write your own answer?I already covered this in my reply.You want to spoil my chances of getting a thank.M
After purchasing Mhada property most purchasers are renting out the Mhada property if they transferred out of city or some other reason. They are like Chawls and mainly meant for weaker sections.

Ms. Usha Kapoor: The client will definitely decide. There is a famous saying, don't confirm your foolishness by opening your mouth.! If you are determined to do so, nobody can stop you. Surely, the querists will discern. Don't worry.
But, You cannot in the name of Expert give irrelevant answers!
When you quoted a news item to buttress your answer to the querist, the news item related to: "...the Maharashtra Housing and Area Development Authority (Mhada) on Tuesday relaxed rules, allowing lottery winners to rent out their flats." The entire story in the news item is how relaxation has been given to the Buyers of Flat under MHADA to rent out their flats, without the need for waiting for 5 years from the date of such purchase!
Whereas the querist wants to know whether he can purchase the MHADA property when only 2 years had expired from date of purchase from MHADA.
Even after being pointed out, instead of correcting your mistake, you appear to be questioning why one is pointing out such error on your part. You question, who I am. Let me tell. I am an ordinary Advocate, answering the queries posed both in the Forum and Expert section.
You question why I have not answered. My answer is simple and straight. Unlike you, who dishes out garbage as an answer to any and every query and still yearns for "the querist to press "like" button, I never venture unless I am aware of the answer. That does not mean that I am so unaware that your answer is totally off the mark!
You say that "I said he need not wait 5 years to buy or rent out the property". Please tell from your story, where it has been said that one can purchase the MHADA allotted property within 2 years of its allotment?
I am least bothered what most purchasers of MHADA property do.
The simple question is whether anybody can purchase the MHADA property from its original allottee within 2 years of its allotment/possession? LET MET REPEAT, YOUR ANSWER IS TOTALLY OFF THE MARK AND MISLEADING TO SAY THE LEAST.
Please note, you may call me spoil sport - yes, I will continue to be, wherever I find the answer totally off the mark, as in the present case.
