Service tax on maintenancae of flat

Is it legal for the society/builder to ask for service tax on maintenance amount

1. IT is lawfully mandatory to collect Service Tax on Service /Maintenance Charges, by the Society /Builder. Failure of which invites Penalty, Interest and prosecution.
