Left job without notice period

Hi,

I worked in Accenture India for 6+ years and left my job after almost one month I submitted my resignation, but HR asked me to complete 90 days period else will initiate absconding process. Since they had initiated absconding process earlier, now they ask me to pay for 2 months notice period which is more than 2 Lacs. I would like to avoid paying this amount if possible, but in worst condition I will pay. But my main concern is that, I should get all my revealing letters, experience letters etc. without any negative remarks. Also in future if any verification comes to the company, there should not be any negative remarks maintained for me in the system of Accenture.
Please provide your precious expert advice.

What do you mean by ‘they’; HR persons?
You have not made it absolutely clear: Did they initiate absconding procedure in your case?

If yes; how?

Did they initiate written communications, memo, show cause notice?

Did you reply to these?

Have they asked you to tender notice pay for 2 months in writing?

Did you resign with immediate effect?

Do you have copy of resignation (or notice) and its proof of dispatch, delivery?

Have you negotiated (in writing) and got positive reply (in writing) that there shall be NO adverse comments on conduct/performance/abscondment in relieving letter/BGV?

It is believed that it is some BPO/KPO/Call center/IT/ITeS operation. Confirm!

What was your designation and nature of duties? Did you have any powers to sanction leave/increment/appoint/terminate/appraise etc?

How many persons were reporting to you?

You were in which state?

You submitted resignation and left thereafter?

Or submitted resignation after one month of your leaving, by say: email/letter thru redg. post?

Or you sent resignation by ordinary post and a copy say; 30days: thereafter by email/letter thru redg. post?

Are you member of BPO/ITeS employees union’s/ employees union’s/trade unions?
What is stated in appointment letter/employee handbook/standing orders/service rules on ;Termination by employer and Employee and exit formalities etc?

Beware of Kumar Doab, a fake expert (without real identity, without photo, without his location in his profile). As of his habit, he always tries cleverly to sidetracks the issues to entirely new direction with his multiple posts consisting of wrong, confusing an vague advice with totally unconcerned multiple pages of downloadable links to make the problem more complex due to which you can feel as if your problem is quite complicated. Although puts innumerable irrelevant questions to the querist, but normally he does not suggest any workable solution to a solution seeker even after his irrelevant 8-10 posts.

As of his habit, through his multiple posts, at first, he normally advises a person to contact some very able counsel and then recommends the names of some of his favourable lawyers, but not knowing much about the subject matter, probably for earning his commission through them.

He has advertised his jealousy, hatred and greed once again to allure you; the one more unsuspecting querist at LCI.

Out of sheer frustration out of an unsound mind, he has pasted the above message on my profile page also, in the dead of night yesterday; 24 January,2017.

You and anyone can check it.
You and anyone can check how many times he has visited my profile in last few days; whopping 39 times.

He must have allured some of his gang members/chamchaas/co-sharers also.

While you check it you may also go thru other messages from even experts regarding habitual provocation and abuse by this Dhingra.

You can read and store all of these and show the printouts to elders of your family, competent and experienced well wishers, employee’s/trade union leaders, your own counsel/lawyer/law firm. It is possible that many of them would already be aware of this abuser, pretender and poser.

While you carefully examine alongwith help of your own family members you will also note that his unsound mind has aggravated his disorders in last 8-10 months to infinite and incurable limits.

His condition was also bad before last 8-10 months.

The shrude and crude Dhingra has been loitering and stalking authors/querist/members/experts for years at LCI.

Before you get carried away and allured by his cries you may go back and go thru threads placed under his profile.

You will find; threads littered with his abuse, attacks, coercion, intimidation, and insult to; authors/querist/members/experts.
He has been operating with two ID’s and his advertisements and declarations at both are fake.

One in this thread in Experts section and one in forum section;

He has tasted one of the corporate flavors and his ID was blocked by admin of LCI.
He advertises his membership w.e.f : 16 June 2016 which is lie and false.

You need to go back to old threads in both Forum and Experts section and see for yourself the abuse, nuisance he has been littering.

He has willfully not posted link to all those threads in which authors/querist/members/experts have posted that ; “Dhingra should not post any reply in the thread…………………….”……………..” Dhingra ; you have nothing else to do” etc etc …………………and you can read and store all of these and show the printouts to elders of your family, competent and experienced well wishers, employee’s/trade union leaders, your own counsel/lawyer/law firm. It is possible that many of them would already be aware of this abuser and poser.

In deed Dhingra has nothing else to do.

The notice period of 90days may not be necessarily applicable in your case.

Your matter can be resolved without litigation also. many threads on similar queries have been resolved at LCI and many of them were employed in your company/trade/sector.

Post your response to all points that has been raised in this thread for you to reply regarding detail of your employment.

Your own elders of your family, competent and experienced well wishers, employee’s/trade union leaders, your own counsel/lawyer/law firm specializing in labor/service matters can guide you the best.

So, he has started abusing me.

BUT IF YOU SEE HIS PREVIOUS THREADS, IN ALMOST ALL THREADS, HE ADVISED THE SOLUTIONS SEEKERS TO CONSULT A VERY ABLE COUNSEL. YOU WILL FIND THE TRUTH ABOUT MY STATEMENT.

From his profile, I find how many people he has tried to dupe with his wrong/ vague advice. Since he has pointed out that I have not posted some threads, now for your information I post below some examples where he misguided the solutions seekers to the extreme of his shrewdness and tried to make the problems complicated by side-tracking the issues to quite a different directions.

FOR EXAMPLE Mr. Kumar Doab confused the authors of a problem pertaining to "wife's share to property" but loaded with his HUNDREDS OF PAGES of google searched irrelevant junk material consisting of amendment of Goa Educational Rules and an Act of succession after death of the owner, while the person was still alive. A question arises, when the problem did not have even a remote concern with education in Goa, for what purpose that link was provided?

ANOTHER EXAMPLE can be seen in the problem of the author concerned with “purchased property without sale deed”, but Mr. Kumar Doab gave the colour of adverse possession due to that even the experts could get misled and concentrated their advice about adverse possession of the property. There are several such type of examples where he used to misguide and confuse the members with his wrong advice in order to lure them to make them diverted to some of his favourite lawyers, probably to earn some commission.

NOW SINCE HE HAS ASSURED YOU, like "Your matter can be resolved without litigation also. many threads on similar queries have been resolved at LCI and many of them were employed in your company/trade/sector," you would be justified to ask him to render his practical help in getting sorting out your problems pertaining to your absence, notice period, experience letter etc.
