Mother's immovable house property sharing -reg.

Dear Sir,
In my mother's name 1 house situated at Bodinayakanur,Tamilnadu.

She received the property from her mother duly registered in her name.

My father died before my marriage.

My mother also expired before 13 years.

My family consists of 2 elder brothers and 1 elder sister including me of total 4 members.

Before 15 years my second brother died and his wife received full and final settlement amount signed in agreement and left to her parents house.

Before 1 year my first brother also died and his wife and 2 daughters(Married), is now receiving the rent income from my mothers house property.

Now my first brothers wife planing to register my mothers house property to her 2 daughters.

Already my 2 brothers sold my fathers land 5 Acres ( self earned property ) and 1 Bungalow belongs to my mother ( gifted by my father ) and at the selling time they given very me-gar amount of RS.2500/-towards for travelling charges to me and my elder sister.

Further they are spreading rumors that she obtained a will from my mother in favor of the property to her 2 daughters.

To the above mentioned situation how can we myself and my elder sister claim our rights in our mothers property.

And also how to inform our rights in our mothers property to Sub-Registrars office at Bodinayakanur,Tamilnadu.

Please kindly requesting your Lawyers Club India to guide me and my elder sister to get our rightful share in our mothers property.

Contact a local lawyer to save your interests. You have share in the property.

your mother was absolute owner of the property . on hear death all 4 children have 1/4th share in the property .
you have stated that on your brother death his widow received some amount in full and final settlement by regd agreement . it is necessary to go through the contents of said agreement as to whether seh and her children have relinquished their share in the property .

you have further stated that some other property has been sold by your brothers and you and your sister have received a meagre share in sale proceeds . it is necessary to go through the documents signed by you for sale of said properties .

contact a local lawyer and file suit for partition and obtain an injunction restraining your brother family from selling any further properties

you 4 children have all equal shares in your mothers and father's self acquired property of house,land ,bungalow etc...

first of all stop the proposed sale of your mothers (gifted) bungalow by your brothers legal heirs.file for injunction restraining and transfer of ownership of the property.then file a suit for declaring your legal rights as legal heir.

also you need to file suit for for your share in the 2 properties already sold by your brothers ,though it is complicated as third party interest was established due to sale .remember god's law is sure but slow to restore every body's legitimate rights.
