Procedure follwed by courts in suitn for defamation.

Sir,

I would like to know the procedure followed by the courts in suits filed for defamation suits.

What will the courts look for on merits.

Academic query. Court follow the procedure as per CPC, CrPC, High court / SC rules. guidelines in all cases. The court will look on merit of the case on the basis of evidences. documents exhibited, arguments law etc before it in regard to the case.

Normal procedure of a civil suit is followed. Whether the facts alleged really defamed the plaintiff will be adjudicated by the court.

1. Defamation suits are civil in nature. So clearly CPC is followed and suit is filed under order 7 rule 1 of CPC.

2. Court fees has to be affixed as per ad valorem .

3. after filing of suit, notice will be issued to defendants.

4. defendants will be given time to file reply.

5. issues will be framed

6. evidence has to be led by plaintiff and defendants

7. arguments

Courts see whether the plaintiff has been able to prove the burden regarding diminishing of reputation of plaintiff in the eyes of other persons. The evidences of plaintiff witness are scrutinized deeply by courts regarding the lowering of reputation of plaintiff in their eyes.
