Advice on vaccate the tenant

dear sir,
i want a advice on this issue. my tenant is not willing to vacate my premises. i have already given one month notice verbally and when i asked her to vacate she is asking for more time. she has already filed a threatening case against me and my husband. pls advice can i send her a legal notice to vacate my premises. she belongs to SC/ST category. can she file any case against me if so how can i vacate her from my premises.

Their is no preferential right of a SC/ST category tenant to retain the property of others. You should have issued a legal notice to her and failing which you might have filed a rent petition seeking her eviction as desired on the basis of your personal need.

if i send her a notice can she file a false case that i have abused her on her SC/ST status if so what can i do.

If you afraid with such events, gift him your entire house and you vacate your house so that he may live peacefully for generations there.

If you are so scare of her caste then why did you inducted her as tenant.
She has already filed suit against you and your husband to protect her from forceful eviction.
You can not evict her unless you serve her one month notice of eviction.
It is not expected now that she would
go to that extreme to lodge any false
cast aspersion case;however there is no guarantee to human mind as to how it
would react to a situation
