Dear Experts,
After a long 13 years litigation atlast a settelment happen in 498-A/406 IPC and 125 Crpc. After getting the settle amount the petitioner / complainant is asking a share in the property which was purchased by the mother of the defendent before his birth in the name of his other two sons. The complainant has 3 children and mother of the defendent has died. Now the petioner asking the share in the said property in the name of her children. Plz suggest best possible option to handle such situation. I am deeply depressed that inspite of spending so much money i have nothing in hand and harassment is still goin on.

why did you pay settlmenet amount before drawing up consent terms . ? go by your lawyer advise . the decison as to whether any share is to be given is ultimately for the accused to decide

In the given case, file a criminal case of fraud against your wife as she played a fraud with you in the name of withdrawing all her case after receipt of decided money and now she is refusing to do so. In a similar case, the court not only ordered such wife to be tried under different sections of IPC but also granted divorce to husband. You need not bow against her illegal demands. Otherwise also the property is not in your name and is in the name of your 2 other brothers so you cannot presurize any person to transfer its ownership in the name of other person without any consideration.

Thnx experts for your valuable advice, but my apprehension is that she may try to tearpass that property by hook and crook.She may put her children ahead to grab the property. can filing a case against her resolved this problem......:(

Do not worry as property is not in your name and there is no liability of others.
let her proceed. in my view you have to wait and watch. in simple words she can not claim the property of others than you.
