Can defendant withdraw the impounded document

(Querist) 05 September 2012 This query is : Resolved 
Defendant submitted an unregistered document Since its an unregistered doc, Hon'ble court impounded doc and got the valuation done by the collector. Now Defendant is not willing to pay the deficit stamp duty decided by collector and defendant feels that paying stamp duty for the impounded document won't help in the current case. At this stage Can defendant withdraw the impounded document?

If the party submitting the unregistered document withdraws the same then there is no need to make the payment of deficit stamp duty. Law is nothing but a common sense though common sense is not so common.

One must have legal knowledge to answer legal query and there is no need of common sense for it and do not equate complexity of law with common sense.

DOCUMENTS ONCE IMPOUNDED CAN NOT BE WITHDRAWN.ONE HAS TO GO WITH PENALTY PROCESS PROVIDED THEREFOR.
