is it possible to frame charges against any person for the purpose of departmental enquiry in the absence of any preliminary enquiry report or complaint in maharashtra

If disciplinary authority is satisfied with the available evidence against the official, he can issue charge sheet and start departmental enquiry forthwith. However, you must first ensure yourself whether the authorities are making preliminary only investigation or have started the process of departmental enquiry.

Preliminary inquiry is also dispensed in certain extraordinary circumstances, such as strikes, atmosphere of intimidation, violence etc. where the competent authority has sufficient evidence - circumstantial or otherwise to believe that the delinquent is responsible for the misconduct.
