i & my wife are staying apart from 03.09.2011..my wife is quite addement for divorce... at no cost c is ready to save this relationship...i love her lot..so just to keep respect for my love & not to make this matter more ugly i decided to give her what c want...yesterday they made me sign petion of mutual consent divorce...

my few querries are:

1) will our mutual lawyer will be able to file that signed joint petition on our behalf..our we both are require to go in court & sign that petition in front of magistrate...

2) our marriage was registered under special marriage act, but they made petition of divorce under sec 13b of HMA... can we get divorce under hindu marriage act... we both are hindu by religion...

3) petition will be submitted on 3rd september,normally how many months will it take to get final decree by court...

4) is new ammendment bill applicable ? is 6 months cooling period is waived off...can court give us decree in 1 month?

both the parties have to go to court . engage your own lawyer to go through contents of petition .

the new amendments have not yet been passed by Parliament . 6 months clloing period is a must .

it should take around a year to get divorce .

I agree with Ld. Sethi.

The new amendments are still not law.

Appoint an advocate and go for first motion ASAP.

You have mentioned that you still love your beloved wife,both of you could have had a family councelling,that would have been some kind of an antidote to save the marriage.What made you sign the mutual divorce papers?You have to engage your own lawyer to avoid future complications.
