I have purcahsed a flat in Pune ....Builder has executed agreement to sale . Sale deed is not yet executed in my name...ossession is hanaded over to me...Now i want to form a Co-operative HSG ....There are more than 100 flast in 4 buildings in the scheme...Do i need builders NOC/assistance to form Co-operative HSG ..can v all flat ownerss form the housing society ourselves without builder...
No sale deed is executed , no completion certificate given....how cn i form a society ..?????
wat shld b my next step ...wat procedure to be followed..

how can posession be handed over in absence of building completion certificate or occupation certificate .
you have not mentioned details when flat was purchased by you .
you have also not mentioned whether agreement for sale has been duly registered .
if registered agreement has not been executed put pressure on builder to do so .
builder is required to execute stamped and registered agreement for sale of flat to you .
all the flat owners can join hnads and then make application to registrar for formation of cooperative society

u r ADVOCATE
take leadership, issue notice to builder to register your sale deed.
Once Majority of flats are Registered, you Register ur hsg society in non co-op of builder, as per rules of society formation.
