Section 173(8) of cr.p.c

(Querist) 28 April 2012 This query is : Resolved 
In a Criminal case the police submitted the charge sheet with the statements of witnesses u/s 161 of Cr.P.C.

Later on some fresh material of criminal conspiracy was placed before the magistrate by the informant and the magistrate ordered police to “Verify the facts and do the needful”.

Later on police submitted the report on Magistrate’s order without any investigation.

Query:-

1. Can informant pray before the magistrate for further investigation u/s 173(8) of Cr.P.C. in the matter as police report is not satisfactory?

2. Any other remedy available?

Yes but in the context of submission of subsequent report re-investigation is no more a likelihood.
