Dismissal from service under iob officers regulations

(Querist) 26 April 2012 This query is : Resolved 
my welknown officer of indian overseas bank has been dismissed from service due to some non compliance of technical and procedural norms but without any monetary loss of the organisation for the implementation of a govt sponsored scheme namely on farm water management scheme of nabard during the year 2004-2006. Decision done on 31/3/12.pl suggest him through this forum/mail how he get relief from that and reinstate in service. note that he was a scale three officer.

whether list of witnesses and documents or the statement of allegations was supplied with it. ?
(iii) whether any official communication was conveyed to the employee regarding appointment of enquiry officer. ?
(iv) whether enquiry officer did not give due and proper opportunity to the petitioner to cross-examine the prosecution witnesses and to lead his own evidence in rebuttal. ?

(v) wheter employee was not supplied with a report of the enquiry officer before the impugned order of his dismissal was passed.

First of all submit appeal to the appellate authority, if prescribed in the IOB's Conduct, Discipline & Appeal Rules.

Based on this sketchy informatin nothing better can be advised. If you need proper advise then elaborate as to what was the charge and how do you think that there was no loss and on what arguments deptt considered the matter fit enough for dismissal. The procedure adopted in the Inqiiry is also relevant while drafting the appeal.

He cannot invoke the provisions of Industrial Disputes Act as he is not a workman. As suggested by esteemed experts, go for appeal.
