Holiday package collapses

I HAD BOOKED A HOLIDAY PACKAGE THRU A SITE CALLED BOOK MY HOLIDAY THRU BAG IT TODAY AN ENTITY WHICH BELONGS TO INDIA TODAY GROUP

I PAID RS 7000 FOR A HOLIDAY PACKAGE AND ALSO BOOKED THE SPECIFIC HOLIDAY BY PAYING RS 750 AS BOOKING FEE AND GOT A CONFIRMATION MAIL

WHEN I PROCEEDED TO THE HOTEL/ RESORT ON SAID DATES I WAS TOLD BY THEM THAT THEY CANT GIVE ME ANY ROOM WITHOUT PAYMENT AS BOOK MY HOLIDAY HAS BEEN DEFAULTING ON PAYMENTS

I CANCELLED MY HOLIDAY AND SENT A MAIL TO BOOK MY HOLIDAY SEEKING COMPENSATION FOR HUGE INCONVENIENCE BUT THERE IS NO RESPONSE

I LIVE IN CHENNAI AND BOOK MY HOLIDAY OPERATES FROM GURGAON AND PAMPHLET SAYS JURISDICTION GURGAON

I HAVE ALL PROOFS IN THE FORM OF E MAILS ETC even from resort i asked them for a mail and they obliged and i have attached the same herewith

You can file a consumer complaint at the counsumer forum which has jurisdiction of the locality where the transaction took place. Here, the payment is made in Chennai and not in Gurgaon.

They have no authority to decide the jurisdiction of cases filed against them. The law is applicable to all equally.

Thus, find a lawuer and file a consumer complaint for deficiency in service and unfair trade practice.

the payment rs7000/- was made by credit card thru internet and rs750/-by demand draft drawn from a chennai bank

Yes. the transaction has taken place in Chennai and you can very well file a case in Chennai.
The jurisdiction mentioned in their pamphlet has no value in the eyes of law unless you expressly agree to the same.
