Purcahse builder floor in up

(Querist) 05 February 2012 This query is : Resolved 
I ONE OF MY CLIENT HAS PAID RS 30 LACS 60% FINANACED FROM BANK FOR PURCHASING A BUILDER FLOOR AT RAJ NAGAR EXTENSION, GHAZIABAD.

BUILDER HAS EXECUTED A AGREEMENT ON RS 100 STAMP PAPER AND THEIR BOOK LET OF AGREEMENT ON WHICH ALL TERMS AND CONTIDIONS ARE MENTIONED.

POSSESSION WILL BE GIVEN BY THE BUILDER IN DEC 2013.

BEFORE PAYING MONEY TO THE BUILDER MY CLIENT REQUESTED THE BUILDER TO EXECUTE THE AGREEMENT AFTER PAYING THE STAMP DUTY.

BUILDER REPLIED THAT STAMP DUTY IS NOT REQUIRED TO BE PAID SINCE THERE IS NO BUILDING IS AVAILABLE NOW ONLY LAND IS THERE.

CONSTRUCITON HAS COMMENCED AFTER EXECUTION OF THE AGREEMENT.

KINDLY SUGGEST :-

IN CASE IN FUTURE BUILDER DON'T PROIVDE THE FLOOR OR DUE TO ANY OTHER REASON HE IS NOT ABLE TO PROVIDE THE POSSESSION WHAT REMEDY IS AVAILABLE.

IN CASE ANY NOTICE IS SERVED BY THE COMMISSIONER OF REVENUE DEPTT, GHAZIABAD.
WHAT REMEDY IS AVAILABLE.
