A girl and boy lived together for 5 yrs and had a son of 5ys later boy left her.
my question is that 1.whether she can claim maintainance for her and her son ?and 2. can the son get his share in his father's ancestral property? .3.is there any provision in indian law for the rights of the girl's interest?

1. Yes under PROTECTION OF Women under Domestic Violence Act.
2. Yes but in respect of his ancestral properties only.

Hindu Marriage Act itself recognises illegitimate child's right of inheritance.

but one thing can you proved that your are live in relationship and with jointly stay as a husband wife for 5 years.

if you proved then you will can get everything, latest high court bench madurai bench order this type of case.

Wife and her child can get maintenance under the provisions of DV act as well as under section 125 of Criminal procedure code. child has got full rights in all the properties of his father viz. ancestral properties during the life time of his father and 1/2 share after demise of his father if the deceased had not made any arrangement qua his self acquired properties. Hindu succession Act is the relevant act for the child as on day.
