Crime Branch Police arrested one person and kept him in police station for 11 days and applying third degree methods has taken sign on white paper and filed FIR after 11 days claiming that he has involved in sign snaching case. However the case was not proved in the Court.
While the case was running in court the police has taken forcefully and threaning him the said persons photo graph and finger prints by and force and even after the case is not proved in court of law, they are saying that a suspect file is opened on him and terrorising him now and then .
What is suspect file ? How to be protected from Police harrasment? When court is not convicted the person ,do they have right to open a suspect file on that person ?
The said person is from a respectable family and doing his PG , what recource is availble to get rid off the said suspect file and police harassment? Plase advise .

When the accused was in police custody, what were his lawyers and family members doing?
Also any statement which is not in front of magistrate and in police custody has no value.
The accused can take this plea in defence.

The family members are innocents and do not know the police high handedness and their litigations
For three days his whereabouts were not known to his family members.When they came to know that he was in police custody with another one of his child hood friend ,who is a policeman son and came to know that their was already physically tortured and taken his disposition that he commited the crime and never let the family members to meet him, they approached the station officer and came to know that he was arrested for giving his two wheeler to his child hood friend, who was the actual snather and did the crime on that vehicle.
Then they approached to higher police official pleading theirs son's future for the release. However he refused by saying that he cannot help since a policeman son is involved and the news is already leaked to newspapers and promised to see that he is released without any case and cheated their parents by lying to them.
They trusted him and due to lack of knowledge of legal procedures, litigations and fearing their sons future and family prestige they did not approach any lawyer,not even their close friends and relatives, hoping he will be released without any case.
After 11 days they came to know that he was he was charge sheeted and put into jail.then they on the advise of their near relative and friends approached the lawyer and got the bail and only after the relaese of their son they came to know that he was falsly implicated in the case to protect the policeman son who was the real culprit .
The parents have stated that there was demand for huge amout of bribe through mediator who was trying for release .
The case is now over and he was aquited guilty free. My query is can they open a suspectsheet on a court aquited person?

There remain many cases untraced. Police under the pressure of the politicians or higher ups or courts have to lodge FIR wherein actual culprits remain out of reach of concerned police station or deliberately those are freed or are not touched. If any person like your friend is caught in connection with some other matter and none cares for such person then all those cases or some of the cases are connected with that person as if he is very hardcore terrorist or gang leader and thus the police takes double benefit.
Police in this way claims solving various long pending unresolved cases by implicating that person as accused establishing false chain of events.
Parents of your friend committed a grave mistake not caring for him for 11 days. Police is still trying to implicate that boy in some more unresolved cases lying pending in the police station. It shall be better for the parents, relatives and heavy weight persons of the locality to personally visit the office of senior police officers and threaten them not to falsely implicate that boy in any case otherwise to face its rebuttal.
Police understands the weight in the language used in the conversation and act accordingly.
