How to take possession

Querist : Anonymous (Querist) 07 December 2011 This query is : Resolved 
In a suit for title and Permanent injection for immovable properties based on a Gift-deed, the appellate court set-aside the decree of the lower court,and orders,

a) The gift deed in void.
b) No relief of title or permanent injection can be given.

Both the court finds that Plaintiff is in possession.If no appeal then,

1) How can the defendant take possession of properties?

2) Can the defendant pray for mesne profit for the period of wrong injection?
