please let me know if really bail we can get in session court against case of sec 380, 420, 467, 468, 471. police has played game and on pressure of political man put all cases on one person who is not involved in any cheating.

as per police statement two person were taking out money by cheque from bank. when both were caught by police in bank then they took the name of 3rd person that they got cheque from 3rd person. when police caught 3rd person, this 3rd person took name of 4th person that 4th person stolen cheque and gave him. in real this 4th person saw this 3rd person in same office. 4th person, he use to go in that office for annual maintenance. but police wrote lie everywhere that 4th person is master mind behind all this and police recovered amount from them. whereas truth is police never allowed that 4th person to go home and never allowed any relative to meet him. then from where they recovered. this 4th person directly told that he is not indulge then why he will pay money. this 3rd person is telling, he has pressure to take his name.

The case is strong, if these are the facts and story is not supported by any other evidence. However, still discretion of the Judge.

please let me know, in whose favour case is strong. whatever i wrote is real fact. nothing i am hiding. whether this we have to tell judge during bail argue? because advocate is not doing anything and not telling judge anything.

Bail is right and at this stage you need not prove or disprove.Pl go through MEHTRE case of SC which is landmark citation in this matter wherein the court ordered AB even in murder case .

The exact observation of S.C. IN CASE REFERRED BY JSDN was "The society has a vital interest in grant or refusal of bail because every criminal offence is the offence against the State. The order granting or refusing bail must reflect perfect balance between the conflicting interests, namely, sanctity of individual liberty and the interest of the society. The law of bails dovetails two conflicting interests namely, on the one hand, the requirements of shielding the society from the hazards of those committing crimes and potentiality of repeating the same crime while on bail and on the other hand absolute adherence of the fundamental principle of criminal jurisprudence regarding presumption of innocence of an accused until he is found guilty and the sanctity of individual liberty."
