To cancel the "banakhat"

(Querist) 28 September 2011 This query is : Resolved
Before 10 days, we have signed the registred banakhat. The terms of the Banakhat is One and Half year. Due to some family dispute / problems, we want to cancel the same. We do not have copy of the same. We do not deposit the cheques in bank, which received against the Banakhat.

Please advise,
Can it be cancelled? if yes, than what will be the procedure?

Thanks

what is "banakhat"?
R.Ramachandran (Expert) 28 September 2011
I surmise - bana khat = binding letter. Probably "Agreement to sell".
Any way let the querist Alpesh Patel clarify.

I agree with mr.R.Ramachandran.
Raj Kumar Makkad (Expert) 28 September 2011
Banakhat as per Gujrai language is "Agreement to sale".

It can be cancelled either with mutual consent or if other party violates any term and condition agreed upon.

After Clarification of "BanaKhat" from Mr. Raj Kumar Makkad, come to question.
do following:-
1. Get certify copy of ATS from Sub-registrar office;

2. Check terms and conditions of that ats;

3. If other party violates any term and conditions as mentioned in ATS then you can cancel ats otherwise no.
