Paying guest accomodation agreement format.

Hi !

Please send me the Agreement format for the Paying Guest accommodation for Girls and Working women. I am actually running a paying guest in my city..

It is very difficult to provide agreement format without having full details. It is better to sit with a local lawyer and brief him your entire process so that he may do the needful.

Not for only Expert Shailesh Kr. Shah but for any body it is risky,if not difficult,to provide any ready made format as things differ party to party,terms to terms.Hence despite the fact that i am providing you one format,I STILL AGREE WITH Mr. Shah ,THAT YOU SHOULD PERSONALLY GET IN TOUCH OF A LAWYER FOR FINAL DRAFT.


THIS AGREEMENT made at Mumbai this ……… day of ………………. BETWEEN ……………………………… hereinafter referred to as "the OWNERS" of the One Part AND ……………………………. Of ………………………………. at …………………….. , hereinafter referred to as "The PAYING GUEST" of the Second Part ;
WHEREAS the Owners are Co-owners and seized and possessed of and is occupying Flat No. …….. , on the ………..floor of the building named and known as "………………" situated at ……………………… Mumbai hereinafter referred to as "the SAID PREMISES" ;

AND WHEREAS the Paying Guest has requested the Owners to allow him use of two bedrooms in the Said Premises for his own use only on a temporary basis on the terms and conditions hereinafter written.

NOW THIS AGREEMENT WITNESSETH as follows :

1. The Owners hereby agree to permit the Paying Guest to use two bedrooms in the aforesaid premises being Flat No. ………, of "………………….." situated at …………………………………. ,, Mumbai, together with the use of the attached bathroom and kitchen on Paying Guest basis.

2. The Paying Guest Agreement shall be for a period of 33 months only commencing from …………………

3. The Paying Guest shall pay an amount of Rs. ………./- (Rupees …………… only) per month. The charges shall include the use of bathroom, kitchen and all the furnitures and fixtures installed in the said room.

4. The Paying Guest has paid at the time of execution hereof a security deposit of Rs…………../- (Rupees ………………….. only) which shall remain with the Owners free of interest, until the termination of this agreement, and shall be returned to the Paying Guest, subject to any deduction for payments due hereunder. Any damage to the furniture / fixtures in the Said Premises shall also be deducted from the security deposit.


5. All charges, dues, taxes, outgoings etc. payable for the Said Premises shall be borne and paid by the Owners.

6. The Owners may allot o the Paying Guest any of the two bedrooms in the Said Premises for the use of the Paying Guest and the Owners may change the allocation at any time during the tendency of the Agreement.

7. The Paying Guest hereby specifically confirms and agrees that he has no right whatsoever to the Said Premises nor shall claim to be tenant / sub-tenant or Licnesee nor shall claim any other right whatsoever in or to the Said Premise.

8. It is clearly agreed and understood that the Paying Guest has not been given any key to the entrance door of the premises nor even to the rooms that are allocated to him for his temporary use from time to time.

9. They Paying Guest may use the passages in the flat for access to the room and may use the kitchen for cooking his own food only provided that no disturbance whatsoever is caused to the use of the kitchen and passages and other portions of the premises by the Owners and their servants and others.

10. The Paying Guest shall not cause any disturbance at any time and may permit guests or any outsider to enter the premises only with the permission of the Owners.

11. In the event that the Paying Guest misuse any of the facilities in the premises or causes any disturbance or delays in making payment of the Paying Guest charges, this Agreement shall stand terminated forthwith and it is hereby specifically agreed and confirmed that the Owners shall be entitled to enter the rooms allocated to the Paying Guest for the time being and to remove all the belongings of the paying Guest and dispose them.

12. This Agreement shall be for a minimum period of eleven months and thereafter if any party is desirous of termination they will give 60 days written notice to the other of his / her intention to do so. At the end of the notice period the contract is deemed to be terminated. If this agreement is not terminated prior to the contract period, then the same shall stand terminated immediately upon the expiry of the period mentioned hereinabove.

13. The Paying Guest shall be responsible for any damage caused by him or by any other outside who has entered the premises through him to the Said Flat and to any of the furniture, fixtures and equipment therein, reasonable wear and tear excepted.

14. Upon termination of this Agreement of the Paying Guest does not vacate the said rooms then he is liable to pay liquidated damages @Rs………./- per day for each day of default.

In the event the Paying Guest is ready to vacate but the owners are unable to
return the Security Deposit as per clause 4 hereof then the Owners will be liable to refund of Security Deposit minus damage.

IN WITNESS WHEREOF the parties hereto have hereunto set and subscribed
their respective hands the day and year first hereinabove written.
