Breach of contract

(Querist) 05 September 2011 This query is : Resolved 
our company has incurred money on the training of its employee. the said employee has signed financial bond. now some of the employees have committed breach of terms and conditions of the said contract. now the company do not want to initiate legal action against them, but want to adopt some other procedure so that the employees rejoin the company. notices has been issued to them, but all our efforts are in vain. kindly suggest

Unfortunately legal recourse through court of law is the only option. Next time ,however, you may ask the prospective employees to keep certain amount of money as security to defray the expenses in case they after taking the training chooses to leave your company.

No employee would be available to you on such terms of security as if they have they will not need employment.

Employee once resigns does not intend to return unless some stringent action is taken.

best course may be amortizing such losses from salary of those employees given such training in anticipation and releasing the same as bonus for loyalty if they do not commit breach..

U may inform the new employer if it is known to U. However, U R entitled only to damages/ compensation for breach of contract & cannot force them to come back as they could not force U to take them in had the case been reverse.
