Motor vehicles act

(Querist) 20 August 2011 This query is : Resolved 
One Pvt.Jeep is insured with us in India, when moving in Nepal person in vehicle was killed by mioist attack.LR's have filed claim in Indian Claims Tribunal for compensation.
My point is-(1)That indian court has no jurisdiction? (2)That as per policy such act of death is not covered in the risk? (3)That driver had no D/L for driving in foreign territory? (4)That no permit to ply in foreign territory?
-Kindly give suggestion on the point that such claim is not tenable in indian court & also appropriate ruling? It's urgent.

you have good grounds to deny compensation under MV Act to the claimants.

though I am not referring to any judgment, but I ll certainly find a few for you.
