I (28yrs) got married to a guy from a matrimonial site in last year june. I am from kolkata and my husband is from Mumbai. After marriage, my husband and in-laws started harrassing me for dowry and even took away all my jewelleries, cash and gifts given during marriage. My husband and in-laws especially my unmarried sister-in-law even mentally tortured me. My father-in-law and mother-in-law's main intention was to marry their son, get adequate dowry and then with that dowry marry their daughter. however when i refused to met their demand, they started torturing me and wanted me to divorce their son. After 2 months of marriage, I became pregnant and my in-laws started forcing me to get an abortion done and leave their home. When i refused to abort the child, they fought with my parents and threatened them of dire consequences if they didnt take me away. One day they even abused my parents over the phone and threatened to throw me out of the home in the middle of the night. The next day my parents brought me back to kolkata in october. Since then till date, my husband had called me up thrice only to fight over trivial issues. Neither he, nor my in-laws have ever enquired about me or my baby who is at present 3 months' old. All my and my baby's expense is being boren by my father. i dont have the money to even consult a lawyer or go to Mumbai and lodge a complaint. Kindly advice me as to what legal action can i take by staying in Kolkata itself and that i dont have to travel all the way to Mumbai with a small baby to look after.

FILE A MAINTENANCE CASE IN KOLKATA UNDER SECTION 125Cr.P.C. STATING ALL FACTS CLAIMING
YOUR STRIDHAN(jewelleries,cash and gifts obtained during marriage)in FAMILY COURT.

File a case in kolkata at your parental residence and that now you are staying over there. File under 125 Cr.P.C. along with 506 IPC and other relevant sections.

You decide one thing clearly that you want reunion with your husband or not.. If you want to reunion mean just be patient and file a restitution of conjugal rights petition along with maintenance case.

If you lodged any police complaint or criminal consequences mean its may make your in laws to anger on you.. Its may make your child's future as question mark. So just try to get fruit full result in your rcr petition.

Respected tom.advocate, i have stated clearly that my husband had abondoned me and my child just because I and my parents didnt meet their demand of dowry. They threw me out of their house in the middle of the nite when I was pregnant and had no where to go. And u are asking me to keep patient and wait for my husband to return? i dont want to go back to my husband as he is the main culprit. What kind of a man would desert his new born baby and leave his wife to maintain herself and a small baby??

For your case effective remedy shall be under Domestic violence act. File a case immediately and claim all rights prescribed under the act. There are many NGO in Kolkata who can render you help like Sutanutir Sakhya, Swayam etc.
