marriage

(Querist) 29 July 2011 This query is : Resolved
My two friends married each other( both adult) aginst wish of their parents in a temple. They have taken photo of marriage and the pandit has also given a certificate. They are threatned by their parents that they will prove this marriage illegal.
They have inquired for court marriage procedure, but have come to know that they have to apply for it in a month advance, and then the registrar sents a copy of notification to their home so as to clearify if their is no objection for their marriage. Hence they have given up this option.
Please suggest how my friends can be legally strenghten their marriage?

Your friend can file an application for registration of marriage along with the true copy of the proof issued by the pandit regarding their marriage. NOthing to worry.

Yes. Am agree with mr. Rajoo. The objection by parents will not be a problem to the spouse. Because both view are major.

i think they have to register the marriage under special marriage act. moreover the marriage done at hindu temple without conversion of name and religion is not valid with respect to muslims and chiristians. So the marriage performed is not valid according to law. So you have to file registration of marriage papers with registrar(district) and he will issue notice and after recording objection the marriage will be registered.

i think author Sumir has not mentioned any where that the duo are muslim and christian,if you have some personal knowledge, then okay.

I CONFIRM OPINION OF

CORRECT IN LAW IF PARTIES TO MARRIAGE ARE NOT HINDUS,TEMPLE MARRIAGE WOULD NOT BE LEGAL.
