Husband is taking divorce from wife in family court. Wife earns more than husband and hence maintenance factor would not be necessary. They stay in flat with very very old mother of husband who is not prudent bcos of her very old age. Flat was self acquired by late father of husband and presently in name of mother. Mother is heavily dependent in old age on wife.After mother flat is bequeathed to husband (or son of mother). Under such circumstances what options are available to husband for divorcing his wife???

Since the property is self acquired by the late father of the husband she can be come under first class legal heir. So no dispute between property and divorce proceedings.

In case before divorce if the husband died mean the wife is entitle to claim share from her husband's propertys.
