I am purchasing agricultural land in karnataka state. so what are precuationery measures i have to take before going registration.Like there is any department which is issuing no due certificate ect. becuase framer usually takes loan on their lands.
which kind of papers I have to check & what kind of papers are there.

Dear Rathnakar,

Firstly you have to verify the minimum 30 years title history of that proparty.

You should have RTC from 1967 to 2008-09;

You should have encumbrance certificate from jurisdictional sub-registrar office for the period from April 1, 1970 to date.

You should have a legal opinion in this regard.

Besides what Mr. Sanjeev Desai has suggested, I would suggest to issue an advertisement in local news paper to invite objections if any.

etc.,
1)for purchasing of the agricultural property you should be an agriculturist else you should be from an agricultural family
2) make sure that the properties are not going to be acquired for the public purpose

Before purchasing the land u will have to make an enquiry about the land how the purchased got the right over the property and u will have obtain the copy of mutuation entry registar which reveals that if there is any loan on the land. U will get this mutuation entry No. in the property extract of the land which you will get immediately at Nemmadi Kendra and I go with Jitendra u will get details of encumbrance over the property in the Mutation entry registar

Before purchasing the Land you should go for revenue searches and tracked the records of 30 years and get mutations entries checked that whether the Land is in the name of the owner/farmer, and checked the records that any encumbrances and Liabilities are marked in the revenue records or any injunction order of any court is their restricting alienating the land/government acquisition/requisitions proceedings are pending for the said Land and whether the Land is available for clear and peaceful possession and having clear & marketable Title.I suggest you to take a Title Report of 30 years and Title Clearance Certificate of without any encumbrances.And I also agree with the above views expressed by my Learned Friends.Thanks.......
