How to get the illegally occupied rented property

Querist : Anonymous (Querist) 15 May 2011 This query is : Resolved
Dear Sir,

I have a residential property in Uttar Pradesh which was given on rent 3 years back on leave and license agreement duly notarized but not registered of 11 months each, however we have verbally told our tenant to vacate the property since their agreement is expiring on 5th June'11, but they have refused to vacate the property and since the tenants daughter has become IPS officer therefore she is taking undue advantage of her position, please help us the best and early way out to get my property vacated as i am a retired government person and want to stay at my house.

apart from tenants position the law is in favor of tenant, you can not evict but by due process of law.

Dear author.. Law will be justify only. Never favour to any one i.p.s or i.a.s officers. If your tenancy period expired mean just leave a legal notice for eviction the tenant.. After that also he not give your possession mean just file a case before sent control tribunal or file an eviction suit.. But you have to proof that the building's need is for your own purpose.

You can file a suit for eviction on the ground that the house is needed for your own use after retirement, if the previous station was out of the place where the house is situated.

serve a legal notice for the termination of licensee/tenancy and file a suit for eviction against the tenants.
you have a good case.
