Full & final payment

Hi!
My husband resigned from his post of GM-Purchase in his previous organisation in the month of April 2010.He resigned very decently with the one month notice period.When he resigned in April,company hold his salary of March month & it was told that they will pay the salary of March & April collectively at the time of final clearance. All the leaving formalities were done properly.On his last working day he was told that company is having fund problem at present and they will send the cheque of final amount through courier in a week time.Since then we are following up on the same nothing has been done.My husband has spoken with the higher authorities such as MD & GM-HR of the organisation all proved waste of time. Kinly suggest what can we do to get our hard earned money from them.

This is not a case of breach of contract.
Your husband can file a suit for recovery of money and/or criminal breach of trust and criminal misappropriation of property. The criminal case is likely to yield faster result for all practical purposes.

your husband have remedy of suit of recovery of money before the Civil Court having jurisdiction in which he can claim all his dues including the terminal dues.

Its two month's salary.The amount will be somewhere arount Rs.90000 & till today interest on this amount because its one year and three months now.
