Excess amount demanded by PG owner

Querist : Anonymous (Querist) 08 March 2011 This query is : Resolved
I am not sure which law this falls under. I had gone to live with a family as PG. The understanding was for Rs 5000 for 1 month. No paperwork was done as after staying there 1 night I discovered that place is not fit to stay. When I offered to pay them they have demanded Rs 1200 saying they will go to the police if I dont pay up. I am a single lady with no relatives/friends in Kolkata. Please advise what needs to be done. Should I pay up to avoid trouble? They have a great nexus with the police and can readily harass me if they want.

file a police complaint against them. If the police have not taken step against them you may file PCR in court

But how do I prove that the agreement was for Rs 5000? There is no written document. I just stayed 1 night and next morning I woke up and left. And what is PCR? Shouldn't I be filing an FIR first?

If you are now not in the PG what is the problem? Which is the document with them to prove you are in PG?

They have threatened that if I don't pay them they will go to police against me. Can they really do it? There is no documentation to prove that I ever stayed there, neither they have any paper agreement with me for any money. The only thing is, while leaving yesterday my wallet with my credit card, mediclaim card and sim card slipped and fell in their room. They are holding it with them saying they will submit to police and if I don't want that I must pay Rs 1200 to get back my things.
