Divorce

Querist : Anonymous (Querist) 27 February 2011 This query is : Resolved
I got married on 26 November 2010. Except a brief encounter on the first night, my wife refuses to have a sexual intercourse. During the honeymoon she slept on a separate bed. In another outstation trip, when I asked her to join the two single beds, she slapped me twice. She displays no love, care or tenderness towards me. She has a volatile temper and even gets violent on occasions. She is from a poor family and wants to enjoy all comforts and financial power available now without feeling responsible. She has gone to her native place to be with her family for some time. I want to divorce her and restrain her from returning. Kindly advise feasibility, grounds and procedure urgently.

I own a house for the last seven years. How can I safeguard it? Can I sell it or transfer it to a family member.

If the marriage is one year old then you could file a suit for divorce on the ground of mental because of her abstinence from sex. If the marriage is not one year old then you have to first obtain liberty of the court to proceed with the case.
Yes in the context of several measures the woman can take against her husband including share in his property ,it would be better if you dispose of the same.

I agree with expert.
If the property is ur individual property she has no right to seek partition. She entitle for maintainance

dear anonymous,

your marriage is hardly 3 months old.

How old is your wife?

Try to take her to a family councillor, before thinking of a divorce so soon.

Unless,we get her version ,it is not fair on any body's part to advice for a divorce proceedings.

YOU MAY KINDLY DISCUSS THE MATTER WITH HER FIRST AND THEN WITH HER FAMILY MEMBERS.SHE MAY BE SICK OR MAY NEED MEDICAL ADVISE.YOU SHOULD NOTE THAT MOST OF THE PRESENT ACTS ARE IN FAVOUR OF MARRIED WOMEN SO BE COOL AND DO NOT INVITE TROUBLE.YOU CAN COMPROMISE THE MATTER WITH MUTUAL DISCUSSIONS.GOOD LUCK.
