Who can receive Lawyer Notice

Querist : Anonymous (Querist) 03 February 2011 This query is : Resolved
Sirs,

The Lawyer's Notice on behalf of wife of 'X' is sent to address of the employer of 'X' at Delhi where as the employee is posted at Kanpur as addressed to X through the employer's Delhi address.

As far as I know the letter should be addressed to X's Kanpur address and the letter be sent to Kanpur.

Notice addressed to X (residing at Kanpur) can not be received by its employer at Delhi.

Learned friends may please clarify whether my perception is correct or not.

Thanks

The notice / communication would be sent only to the last known address. Therefore sending of the legal notice to the last known address is not wrong. But, if your office people at Delhi have been given instructions by you not to accept any communication coming to your Delhi address then they should not have received it. They should have returned it saying that the person is not any more at Delhi and that he has shifted base to Kanpur. They can also give the Kanpur address of yours if they so desire. Having not done that and having accepted the letter, they willbe forwarding the same to you at Kanpur. In any case, you having received the notice (of course through your Delhi office) and having known the contents cannot object that it should have been addressed to you at Kanpur. If the Delhi Office had not accepted the notice, that would be altogether a different matter.

if it is already within your knowledge and accepted by your employer on your behalf better to send a reply on merits to it.
